Maternity Leave can be extended if the doctor recommends and provides documentation for additional recovery time. Employers can provide paid parental leave in enterprise or other registered agreements, employment contracts and workplace policies. The amount of leave and pay entitlements depends on the relevant agreement, contract or policy.

All pregnant employees have the right to 52 weeks maternity leave. Many of the maternity provisions are statutory or form part of the national terms and conditions of service.
